End User License Agreement (EULA)
Zippin (“we”, “our”, or “us”) uses the next generation of checkout-free technology to remove friction from shopping for a more enjoyable experience. This End User License Agreement (EULA) governs your use of our technology, including our mobile application, website, and stores (collectively, the "Services" or “Store”).
By using the Services, you agree to be bound by this EULA. If you do not agree to this EULA, you may not use the Services.
1. Use of Services
Our technology-enabled store grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services for your personal, non-commercial use only.
By shopping in our store, you acknowledge that our technology will determine the items you and your guests take from the store. You agree to be charged for the items taken by you and your guests using the form of payment you used to enter the store, or for stores without credit card or app entry, the form of payment used in the store.
Receipts will be made available at shop.getzippin.com, or for app users, within the app.
Refunds will be provided for spoiled items or items not taken, however, we reserve the right to deny refunds and terminate access to the Store at our discretion.
You may not:
- copy, modify, distribute, sell, or lease any part of the Services;
- reverse engineer or attempt to extract the source code of the Services;
- use the Services for any illegal or unauthorized purpose;
- interfere with or disrupt the Services or servers or networks connected to the Services;
- access the Services through any technology or means other than those approved by us; or
- use the Services in any way that could harm us or any third party.
The Services and all related intellectual property rights are owned by us or our licensors. You may not use any trademarks, service marks, or logos belonging to us without our prior written consent.
5. Changes to the Agreement
We reserve the right to modify these terms at any time, and by continuing to use the Store, you are accepting any revised terms. We cannot guarantee that the Store, its functionality, or app or receipt content is accurate, reliable, or complete in all circumstances.
6. Acceptance of Terms
By using the Store, you agree to be bound by the terms and conditions of this Agreement.
This EULA is effective until terminated by either party. We may terminate this EULA at any time if you breach any of its terms. Upon termination, you must immediately cease all use of the Services and destroy all copies of any materials in your possession.

9. Disclaimer of Warranties
The Services are provided "as is” without warrant of any kind, either express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
In no event shall we or our licensors be liable for any damages arising from the use of the Services, including without limitation direct, indirect, incidental, punitive, or consequential damages.
11. Dispute Resolution
Any dispute or claim arising from or relating to this agreement or the Store is subject to binding arbitration in the state of California.
12. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which our technology-enabled store is located, without giving effect to any principles of conflicts of law.
